These Terms & Conditions govern your use of the Alomar Marketing LLC website and services. By accessing our website or engaging our services, you agree to these terms.

1. Services Description

Alomar Marketing LLC provides done-for-you paid advertising management services, including but not limited to: Google Ads, Meta (Facebook & Instagram) Ads, TikTok Ads, YouTube Ads, Amazon Ads, LinkedIn Ads, AI creative production, click fraud protection, and AI-powered lead follow-up. Advertising spend is separate from management fees and is paid directly to the advertising platforms.

2. No Guarantee of Results

Advertising performance varies based on industry, budget, market conditions, competition, campaign execution, and other factors outside our control. We do not guarantee specific results, including but not limited to: number of leads, cost per lead, cost per acquisition, return on ad spend (ROAS), or revenue. Any testimonials or case studies reflect individual results and are not indicative of future performance.

3. Billing & Payment

• Management fees are billed on a month-to-month basis
• No standard setup fees unless otherwise agreed in writing
• Advertising spend is paid directly to platforms (Google, Meta, etc.)
• Management fees do not include advertising spend
• You are responsible for all advertising spend on your accounts
• Cancellation requires notice as specified in your service agreement

4. Client Responsibilities

• Provide accurate information about your business and target audience
• Grant read-only or appropriate access to advertising accounts
• Approve campaigns and creative in a timely manner
• Maintain sufficient advertising budget on platform accounts
• Respond to communications from our team within a reasonable timeframe

5. AI & Automated Communications

We may use AI-powered voice assistants and automated SMS/email systems to contact and qualify leads on your behalf. By providing consent on our forms, you acknowledge that:

• AI voice assistants may call leads and identify themselves as AI
• Automated SMS and email follow-up may be sent to leads
• All calls and messages comply with TCPA and applicable regulations
• You are responsible for obtaining proper consent from your leads

6. Intellectual Property

All content on this website, including text, graphics, logos, and software, is the property of Alomar Marketing LLC or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

7. Limitation of Liability

To the maximum extent permitted by law, Alomar Marketing LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including but not limited to lost revenue, lost profits, or wasted advertising spend. Our total liability shall not exceed the management fees paid by you in the preceding three (3) months.

8. Indemnification

You agree to indemnify and hold harmless Alomar Marketing LLC and its team from any claims, damages, or expenses arising from your use of our services, your advertising content, or your breach of these terms.

9. Governing Law

These Terms & Conditions are governed by the laws of the State of New Jersey, United States. Any disputes shall be resolved in the courts of New Jersey.

10. Changes to These Terms

We may update these Terms & Conditions at any time. Changes are effective immediately upon posting on this page. Continued use of our services constitutes acceptance of the updated terms.
