Weekly Services Fees and Cancellation

Weekly fees cover setup, substantive strategy/advice by email or text, analysis, monitoring, adjustments, and maintaining effective campaigns unchanged. Agency may document its work. No edit or sale during a week does not alone entitle Client to a refund.

Earned fees for services rendered are nonrefundable. A billing message, automated acknowledgment, or communication alone does not prove all services were performed. Agency remains responsible for material nonperformance and required refunds. Setup is earned as performed; unearned setup/prepaid services are refunded or credited. Final partial weeks are prorated.

Weekly advance billing follows the order, including prelaunch setup. Plans A, D, and F last 12 calendar months from the Effective Date, or later written activation for added services, without automatic renewal. Plans B/C continue weekly; G monthly at $197 plus approved provider fees; E follows ordered hours.

Recurring services may be canceled with 30 calendar days’ email notice to support@alomarmarketing.com, naming the business, service, and end date. Notice counts on receipt without an undeliverable response; agreed services and fees continue during notice. Annual plans still carry the commitment and early-cancellation terms below.

Early cancellation of an annual plan, or termination for Client’s uncured material breach, carries a $3,000 charge, capped at unpaid fees remaining for terminated annual services. One combined charge applies when annual plans end together. It must reasonably compensate anticipated losses after avoided costs; Agency must substantiate it and cannot accelerate future fees or double-recover. If unenforceable, only lawful damages may be sought. Plans B, C, E, and G have no early termination charge.

Setup, Learning Period, and Support

Agency will launch approved campaigns within 30 calendar days, subject to timely payment, access, verification, assets, approvals, and platform permission. Delays require prompt notice and a revised date. Allow 7–14 days after Meta launch without routine edits to campaign, budget, audience, creative, or copy. Monitoring continues; urgency, unauthorized spend, law, or platform instructions may require edits/pauses. Learning completion is not guaranteed.

Business hours: Monday–Friday, 9 a.m.–5 p.m. Eastern, excluding major US holidays. Email support@alomarmarketing.com for an initial reply within 1–2 business days (normally 24–48 hours excluding weekends/holidays). Resolution may take longer. Routine pauses, changes, feedback, and issues use this queue unless emergency service is authorized.

Plan E requires written approval and staff availability. The $100 one-hour minimum applies even to a one- or two-minute response or adjustment. Billing starts when authorized work begins; additional time is $100/hour, prorated by minutes. Prepaid hours are debited without duplicate charges; unused hours carry forward and are refundable at closure. Extra hours need approval. Prepayment does not guarantee instant or round-the-clock response. Routine tickets or automated replies alone trigger no emergency fee.

Platform Decisions, Restrictions, and Billing Pauses

Meta, Google, Amazon, and other providers independently control approvals, delivery, privacy/tracking changes, outages, and account restrictions. Agency does not guarantee uninterrupted access or reinstatement and is not responsible for independent platform actions outside its reasonable control. This does not excuse Agency’s own breach, negligence, or unlawful conduct.

If restrictions block service, Agency notifies Client and confirms continued authorized strategy/appeals, affected billing pauses, or a separate compliant setup. If no agreed work can be provided, affected future fees pause and unearned prepayments are credited/refunded. New setup fees or term extensions need written approval. Replacement/rented accounts must be permitted and cannot evade platform enforcement. Earned past fees follow the refund terms.

Outreach, Hosting, and Shared Responsibilities

Plan C’s assigned hour includes dialing, conversations, voicemails, and notes. Calls, answers, interest, appointments, and sales are not guaranteed. Client supplies its lawful list, offer, script, and goals. Both parties follow consent, Do Not Call, opt-out, and calling-hour rules. Phone/email/text setup, registrations, numbers, usage, and software are separate unless expressly included. Plan G includes AI setup and management only, with provider charges funded by Client under the AI Addendum. Voice AI and unlimited live staffing are separate. Message and data rates may apply.

Sub-accounts, workflows, integrations, pipelines, templates, hosted pages, and managed records sit under Agency administration. Client receives use during paid service; at departure access ends and the hosted system/configurations are not transferred, cloned, or migrated. Client retains rights in supplied information and customer data, including legally required access, return, export, deletion, and retention. Both parties protect confidential information and personal data. Client normally retains its platform accounts and may use paid final creative, subject to third-party/AI rights; Agency retains its tools and templates.

Agency uses reasonable care and follows applicable New Jersey/federal law and platform rules. Client supplies truthful offers, claim evidence, rights, licenses, privacy notices, consents, and written creative/budget approvals. AI work receives review; fake reviews/endorsements are prohibited. Agency may refuse prohibited work. No leads, qualification level, appointments, purchases, rankings, profit, ROAS, or other results are guaranteed; ROAS is not profit. Guidance is not legal advice or guaranteed compliance. Leads are enquiries, not buyers. Available leads use configured email, SMS, call transfer, or CRM workflows. Client must follow up; purchases may create upsell or repeat-business opportunities.

Either party may terminate an uncured material breach after 10 calendar days’ written notice. Agency may suspend unpaid work after notice, pause unsafe/unlawful activity immediately, or terminate for convenience with 30 days’ notice. No early termination fee applies to Agency’s convenience termination or Client’s valid termination for Agency’s uncured breach. Campaigns pause at closure unless Client lawfully instructs otherwise.

To the lawful extent, consequential/speculative profit losses are excluded and liability is capped at three months’ preceding service fees paid or payable. Earned fees and valid cancellation charges remain due. Caps exclude fraud, willful misconduct, gross negligence, confidentiality/data breaches, and nonwaivable statutory rights, including applicable New Jersey Consumer Fraud Act protections. Neither party will knowingly publish false factual statements; honest reviews, opinions, truthful statements, legal claims, and protected complaints remain allowed.

New Jersey law governs; New Jersey courts with jurisdiction may hear disputes. Agency remains responsible for its team. These terms and approved orders form the agreement; changes require mutual written acceptance. Electronic signatures are valid; invalid provisions are severed to the lawful extent. Agency may recommend Client to appropriate businesses with consent before sharing private details; referrals are not guaranteed.
